1. Scope of Application:

1.1. The following terms of service govern use of the website www.bdsi.de

This website is run by the Association of the German Confectionery Industry, 53113 Bonn (hereinafter referred to as “BDSI”).

1.2. Please read through these terms of service carefully before you use the BDSI website. By using this website you agree to these terms of service. Use of this website is only permissible on the basis of these terms of service.

1.3. The BDSI reserves the right to change these terms of service at any time.

2. Liability

2.1. Although the content of this website has been put together with the greatest of care, the BDSI assumes no liability for the currentness, correctness, completeness, or quality of the information provided. Any liability claims against the BDSI arising from the use of erroneous and/or incomplete information are fundamentally excluded in as far as the BDSI has not acted in a grossly negligent manner.

2.2. The BDSI shall be entitled to stop, change, and/or delete the website and its operation. Hence the BDSI assumes no liability for the constant accessibility of the website.

2.3. Although the BDSI shall always make every effort to ensure that the BDSI website is free of computer viruses, the BDSI cannot guarantee the absence of computer viruses. Before downloading information the user shall, for his or her own protection as well is to prevent viruses gaining access to the BDSI website, provide for appropriate security measures and virus scanners.

2.4. As a content provider within the meaning of Section 7 of the German Telemedia Act (TMG), the BDSI is responsible for “own content” it provides for use, pursuant to general legislation. This own content is to be distinguished from links to content made available by other providers. The BDSI does not check the content of these third-party links. However, if the BDSI establishes, or is informed by third parties, that the content of the third-party website or document to which the BDSI has provided a link has triggered a liability under civil or criminal law, the BDSI shall immediately remove the link to the said offering.

3. Registration

3.1. In the event that the BDSI protects access to the website in part or in whole by a password, access to its webpages shall only be available to registered users. The user shall have no right to his or her registration on the website being accepted by the BDSI.

If the user wishes to register, he or she must provide true and correct information when registering and immediately make any subsequent appropriate changes when asked about the currentness of such information on next using the website.

3.2. The user alone shall be responsible for the security of his or her password. Disclosure of the password to third parties is not permitted. If the password becomes known to unauthorised persons, the user must immediately change his or her password.

All content of this website, particularly logos, video clips, films, photos, texts, trade names and brand names are protected by copyright and other intellectual property rights. Without obtaining prior written consent from the BDSI, users shall not be permitted to reproduce, change, duplicate, sell, or use for commercial or non-commercial purposes any intellectual property or other content from the BDSI website.

5. Consequences of Inadmissible Use

Notwithstanding other rights (regardless of whether these are governed by statutory law or other regulations), the BDSI reserves the right to delete orders placed by the user and/or refuse the user access to the BDSI website if the user infringes these terms of service.

6. Law of Contract and Place of Jurisdiction

These terms of service shall be governed by the law of the Federal Republic of Germany. Any disputes arising hereunder shall be settled by a competent court of law in Bonn, in as far as the user is a merchant.

7. General Provisions

7.1. Should a particular provision hereunder be invalid or become so, this shall not affect the validity of the remaining provisions.

7.2. If a user has doubts about the security of this website or copyrights or brand rights, he shall be obliged to correspondingly inform the BDSI at this e-mail address.
